Message from the ETMF President & CEO
Dear Students, Educational Institutions, Families, and Community Members,
As President and CEO of the Empowerment Through Mindset Foundation (ETMF), I am writing on behalf of the board of directors to address the serious reality we face following the implementation of Senate Bill 4 (SB 4) in Texas and recent executive orders that have significantly impacted our community.
We must acknowledge the painful truth that some of our community members have been deported, and many families have been separated. While we cannot reverse these actions, we can focus on empowering education and community by providing clear information about safety and rights.
To Our Students
Young minds represent our future, and your right to education is fundamental and protected by law. I want you to know:
Your Education is Your Right:
The Supreme Court has established that every child, regardless of immigration status, has the right to attend public school. This is supported by the landmark case Plyler v. Doe (1982), which ruled that undocumented children have a constitutional right to a free public education.
You Belong in Our Classrooms:
Your presence enriches our educational community and contributes to the diverse fabric of our society. Your dreams, aspirations, and potential are valuable, and we are committed to protecting your right to pursue them.
Higher Education Opportunities:
In Texas, undocumented students may be eligible for in-state tuition under the Texas Dream Act if they meet specific requirements. However, recent legislative actions, such as H.B. 160, propose changes to this policy. We will continue to advocate for policies that support access to higher education for all students.
School Safety and Immigration Enforcement
Schools should have robust plans in place in case immigration officers show up on their campuses. These plans should include guidance on how to interact with officers and what to do if a child's parent does not show up to pick them up from school, presumably because of an immigration-related arrest.
Recently, the Trump administration removed protections on sensitive places like schools, allowing immigration authorities to conduct arrests there. However, federal authorities typically need a warrant to enter schools, and administrators can keep them out without one. Important Steps for Students and Parents:
Know Your School's Policies:
Familiarize yourself with your school's policies regarding immigration enforcement.
Emergency Contacts:
Ensure the school has up-to-date emergency contact information for your family.
Designate Trusted Individuals:
Identify trusted individuals who can pick you up from school if your parents are unable to do so.
Inform Your School:
If you have concerns about potential immigration enforcement actions, inform your child's school.
Rights of Parents and Children
Parents have constitutional rights to the custody of their children, regardless of immigration status. If you're a parent:
Emergency Plans:
Ensure your children know who to contact if you don't come home.
Power of Attorney:
Consider setting up a power of attorney for a trusted individual to make decisions for your children if you're detained.
School Information:
Make sure your children's school has updated emergency contact information.
Safety at Home:
Teach your children not to open the door to strangers and what to do if ICE comes to your home.
To Our Community Members
As parents, guardians, and community leaders, you are the backbone of our society. We understand your concerns and want to empower you with knowledge and resources:
Understanding Your Rights
